Acceptance of Terms

This Terms of Service Agreement (the “TOS”) governs your use of the website operated by Axer Strategies, LLC (“Axer,” “we,” “us,” or “our”), located at 3838 Oak Lawn Ave, Suite #1000, Dallas, TX 75219, including the site at www.axerstrategies.com (the “Site”).

Description of the Site

The Site provides information about Axer’s marketing infrastructure consulting services for B2B companies. Visitors may use the Site’s contact form to submit information and request a consultation. Axer reserves the right to modify, update, or discontinue any part of the Site’s content or functionality at any time without prior notice, and shall not be liable for any such changes.

Use of the Site

The Site does not require registration or an account to access its content. If you submit information through our contact form, that information is handled in accordance with our Privacy Policy.

You agree to use the Site only for lawful purposes. You agree not to:

  1. use the Site in any way that violates applicable local, state, national, or international law;

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnity

You agree to indemnify and hold Axer Strategies and its officers, employees, agents, and affiliates harmless from any claim or demand, including reasonable attorney fees, arising out of your violation of this TOS or your misuse of the Site.

Third-Party Beneficiaries

Except as expressly stated in this TOS, there are no third-party beneficiaries to this agreement.

Notice

We may provide notices to you regarding changes to this TOS via email, posting on the Site, or other reasonable means.

General

Entire Agreement

This TOS constitutes the entire agreement between you and Axer Strategies regarding use of the Site, superseding any prior version.

Governing Law and Forum

This TOS shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from this TOS or your use of the Site shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of those courts.

Waiver and Severability

Our failure to enforce any provision of this TOS shall not constitute a waiver of that provision. If any provision is found invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Statute of Limitations

Any claim arising out of or related to your use of the Site or this TOS must be filed within two (2) years after the claim arose, or it will be permanently barred.
